This Service Agreement (“Agreement”) governs your use of jointheweekly.com and any membership, chef-prepared meal, Market purchase, delivery, or related service offered by The Weekly Living LLC (“The Weekly,” “we,” “us,” or “our”). By creating an account, purchasing a membership, placing an order, or using our services, you agree to this Agreement and our Privacy Practices.

Eligibility and Accounts

You must be at least 18 years old and legally able to enter into a contract to make a purchase. You are responsible for providing accurate information, protecting your login credentials, and promptly updating your account, payment, and delivery information. You are responsible for activity conducted through your account unless prohibited by law.

We may refuse, suspend, or cancel an account or order when reasonably necessary to address fraud, abuse, safety concerns, payment failure, service unavailability, or a violation of this Agreement.

Memberships and Automatic Renewal

Memberships are recurring subscriptions. The price, billing frequency, included meal allowance, Reserve allowance, and other plan benefits shown at checkout form part of this Agreement.

Unless you cancel before the next renewal date, your membership will automatically renew at the billing frequency displayed at checkout, and you authorize us or our payment provider to charge your saved payment method for the then-current membership price and applicable taxes or fees.

You may cancel through the account tools made available on the website or by contacting us through jointheweekly.com before your next renewal is processed. Cancellation stops future renewals but does not ordinarily reverse a charge already processed or refund a current membership period, except where required by law or expressly stated in a written refund policy. You remain responsible for orders and charges incurred before cancellation.

We may change membership prices or benefits prospectively. We will provide notice before a material change takes effect when required by law. Continuing the membership after the effective date of the change constitutes acceptance of the updated terms. If you do not agree, you must cancel before the next renewal.

Membership benefits, unused meal selections, Reserve selections, credits, or discounts do not roll over unless we expressly state otherwise. Memberships and benefits are personal, nontransferable, and have no cash value.

Chef-Prepared Meals and Weekly Selections

Available meals, ingredients, portion sizes, nutrition information, chefs, preparation methods, and Reserve selections may change from week to week. Photographs are illustrative; actual presentation, color, ingredients, and portion appearance may vary.

Selections are subject to deadlines, inventory, plan allowances, Reserve limits, delivery capacity, and geographic availability. If you do not make selections by the stated deadline, we may apply the default-selection, skip, credit, or other fulfillment process disclosed for your plan at that time.

Guest Market Purchases

Eligible Market products may be purchased without an active membership when the website permits. Guest Market purchases do not include membership benefits unless expressly stated. Product availability, minimums, delivery fees, service areas, and fulfillment schedules may differ from membership orders.

Pricing and Payment

Prices are displayed in U.S. dollars and may change without notice before purchase. Taxes, delivery charges, service charges, gratuities, and other disclosed fees may be added at checkout. You authorize us and our payment providers to charge the payment method you submit for all amounts shown at checkout and any recurring membership charges you approve.

If a price or product description contains an obvious error, we may cancel the affected item or order and issue an appropriate refund rather than fulfill it at the incorrect price.

Delivery

Delivery dates and windows are estimates, not guarantees. Weather, traffic, product availability, staffing, access restrictions, emergencies, and other circumstances may cause delays or rescheduling.

You are responsible for providing a complete, accurate, and safe delivery address; access instructions; gate or building information; and a working telephone number. You must ensure that someone can receive the order when required and that perishable food is retrieved and properly refrigerated promptly after delivery.

When you authorize an unattended delivery, you accept the risks of loss, theft, tampering, weather exposure, pests, and temperature changes after the order is delivered to the address or location you specified. We are not responsible for deterioration or loss caused by delayed retrieval, an incorrect address, inaccessible premises, or unsafe delivery instructions.

If delivery cannot be completed because of inaccurate information, lack of access, an unsafe condition, or an unavailable recipient, the order may be treated as fulfilled and may not be refundable, to the extent permitted by law.

Substitutions and Availability

Food is seasonal and inventory can change. We may substitute an item with a reasonably comparable item, adjust a recipe, or omit an unavailable item. Substitutions may differ in ingredients, nutritional content, allergens, size, brand, or value. If you cannot accept substitutions because of an allergy or other concern, contact us before the selection deadline and review all labels and ingredient information before consumption.

We may limit quantities, discontinue items, or cancel an unavailable item. When appropriate, we may provide a substitute, account credit, partial refund, or refund of the affected item at our reasonable discretion and as required by law.

Allergies, Cross-Contact, and Dietary Needs

Food may be prepared, stored, packaged, or transported in facilities and equipment that handle milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans, sesame, and other ingredients that may cause allergic reactions. Cross-contact can occur even when an allergen is not intentionally included in a recipe.

We do not guarantee that any meal or product is free from allergens, gluten, animal products, or other ingredients unless we expressly provide a written guarantee for that specific item. Menu descriptions, dietary labels, and customer preferences are informational and are not medical advice.

Customers with food allergies, celiac disease, sensitivities, pregnancy-related restrictions, or other medical dietary needs are responsible for reviewing available ingredient and allergen information, reading product labels, contacting us with questions before ordering, and deciding with a qualified healthcare professional whether an item is appropriate. Do not consume an item if its identity, ingredients, packaging, or allergen information is unclear.

If you believe you are experiencing a serious allergic reaction, stop eating and seek emergency medical assistance immediately. To the fullest extent permitted by law, The Weekly is not liable for an allergic reaction or dietary injury resulting from an allergen disclosed in available information, customer failure to review information or communicate a restriction, third-party labeling, or unavoidable cross-contact. Nothing in this Agreement waives liability that cannot legally be waived.

Food Handling and Consumption

Follow all storage, refrigeration, reheating, use-by, and handling instructions supplied with an item. Refrigerate perishable food promptly. Do not consume food that is damaged, improperly sealed, left unrefrigerated, past its use-by date, or otherwise appears unsafe.

Once delivered, you are responsible for safe storage, handling, preparation, and consumption. Nutrition and wellness information is general information only and is not medical, nutritional, or dietary advice.

Cancellations, Refunds, and Credits

Because meals and perishable goods are procured and prepared in advance, orders may become final after the applicable selection or cancellation deadline. Except where required by law, we do not guarantee refunds for missed deadlines, preference-based dissatisfaction, completed deliveries, unattended-delivery issues, or items discarded without giving us a reasonable opportunity to review the concern.

If an item is missing, damaged, spoiled on arrival, or materially different from what was ordered, contact us promptly through jointheweekly.com with the order number and, when reasonably requested, photographs or other details. We may provide a replacement, account credit, partial refund, or refund, depending on the circumstances. Credits are promotional, nontransferable, have no cash value, and may expire as disclosed.

Promotions and Gift Offers

Promotions, discounts, referral benefits, gift cards, and trial offers may have separate conditions and expiration dates. They may not be combined unless expressly permitted and may be modified or withdrawn before redemption, subject to applicable law. Abuse, resale, or fraud may result in cancellation.

Communications

You agree that we may send transactional communications concerning your account, membership, orders, payments, deliveries, safety notices, and changes to our services.

If you separately consent to marketing emails or text messages, we may send promotional communications consistent with that consent. Consent to marketing texts is not a condition of purchase. Message and data rates may apply; message frequency may vary. Reply STOP to opt out of promotional texts and use the unsubscribe link to opt out of promotional emails. Opting out of marketing does not prevent necessary transactional communications.

Website Use and Intellectual Property

The website and its content, branding, photographs, designs, text, software, and other materials are owned by or licensed to The Weekly and are protected by law. You may use the website only for personal, lawful purposes. You may not interfere with the website, bypass access controls, scrape or copy content at scale, misuse promotions, submit false information, or use our materials commercially without written permission.

Third-Party Services

Our services may rely on third parties, including payment, ecommerce, delivery, analytics, communications, and hosting providers. We are not responsible for independent third-party services, websites, or acts outside our reasonable control, except where applicable law provides otherwise.

Disclaimer of Warranties

To the fullest extent permitted by law, the website, memberships, products, and services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement, except warranties that cannot legally be disclaimed. We do not guarantee uninterrupted website access, continuous product availability, specific health or nutritional outcomes, or delivery at an exact time.

Limitation of Liability

To the fullest extent permitted by law, The Weekly Living LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill arising from the services.

To the fullest extent permitted by law, our total liability for a claim relating to a particular order, membership period, product, or service will not exceed the amount you paid to The Weekly for the order, membership period, product, or service giving rise to the claim during the three months before the event giving rise to liability.

These limitations do not apply to liability that cannot be limited under applicable law, including where applicable for fraud, willful misconduct, or personal injury caused by legally actionable conduct.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless The Weekly Living LLC and its owners, employees, contractors, and service providers from third-party claims, losses, and reasonable expenses arising from your unlawful misuse of the website or services, your violation of this Agreement, or information or instructions you provide that cause harm, except to the extent caused by The Weekly’s own legally actionable conduct.

Events Beyond Our Reasonable Control

We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, natural disasters, public-health emergencies, utility or internet failures, supply shortages, transportation interruptions, labor disruptions, government actions, or failures of third-party providers.

Governing Law and Disputes

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law principles. Before filing a legal claim, you and The Weekly agree to make a good-faith effort to resolve the dispute informally by sending a written description through the Contact page at jointheweekly.com and allowing 30 days for a response.

If the dispute is not resolved, it may be brought in a court of competent jurisdiction in Florida, subject to applicable law. Nothing in this section prevents either party from seeking appropriate relief in small claims court or urgent injunctive relief, or limits any nonwaivable consumer right.

Changes to This Agreement

We may update this Agreement prospectively. The updated Agreement will be posted with a revised effective date. We will provide additional notice of material changes when required by law. Changes do not retroactively alter a dispute that arose before the updated terms became effective.

Severability and Entire Agreement

If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect. This Agreement, the Privacy Practices notice, the terms displayed at checkout, and any plan- or promotion-specific terms form the entire agreement between you and The Weekly concerning the services.
